Notes |
- John Davis Jr, Birth: ca 1750; Death: ca 1812, Wythe County, VA, Wife Mary
1781 - George and John Hutsell and John Davis migrated to Montgomery Co. (now Wythe Co.), VA prior to 1781.
1798 - Jan: John Davis (not clear whether Jr. or Sr.) appeared before the
court and because his wife did not wish to prosecute he was discharged. No
other details were given. (Must be Jr. as Sr. was dead by this date. HB)
Mar. 14: Mary, wife of John Davis, was to appear and show cause why she
should not be allowed to commence suit against him for separate maintenance.
1799 - Feb: Polly Davis presented a petition to court and she was granted
the right to bring action against her husband John for alimony.
1812 - Jun 7: John Davis, Jr. died of natural causes in Wythe Co., VA
according to the coroner's report.
1814 -A lawsuit filed by Henry Hufford in 1814 (ended in 1817) names the
children and heirs of John Davis, Jr., deceased. They were John Davis, III,
George Davis, William Davis, Larkin Johnson and his wife, Polly, William
Ferguson and Susannah, Spencer Lehue and wife, Peggy, Charles J. Woodson and
wife, Caty, Jacob Harrell and wife, Anne, and Abram Davis. In addition Henry
Hufford stated that he had married Elizabeth, a daughter of John Davis,
deceased, and that she had died on May 10, 1813, after her father, but they
had been promised a tract of one acre one-fourth and twenty-eight poles
adjoining William Hay, and including a line crossing Cedar Run, for which he
had never received a deed. The Ferguson's and George Davis were not
inhabitants of Virginia at the time of the suit. In 1816 the court orders
refer to all of the same heirs in a suit brought by Jesse Evans, but added
Jacob Whitmore and Nancy Whitmore (father & daughter). Those suit papers
have not been located, but in 1813 Henry Hufford was appointed guardian for
Nancy, orphan of Jacob Whitmore. In an early case Jacob Whitmore was
identified as the son-in-law of John Davis. [Wythe County Chancery, Hufford
vs. Davis' Reps., 1817-27-CC (New Number 601); Wythe County Court Order Book
1812-1815, p. 99; Order Book 1815-1820, p. 41; Chancery, Davis Vs. Woolford,
1807-03]2 Vol IV, pp. 106-107.
The children of John Davis, II, appear in an order book on February 14, 1816 when Jesse Evans brought suit against the heirs of John Davis
named as follows: John , George , William , and Abraham Davis , Larkin Johnson [usually Johnston] and his wife Polly who was a Davis , Charles J. Woodson and his wife Caty who was a Davis , Spencer Lehue and his wife Peggy who was a Davis, JACOB HARRELL AND HIS WIFE ANNE, WHO WAS A DAVIS, Jacob Whitmore and his wife Nancy who was a Davis, and appears to have married second Henry Hufford , William Ferguson and
his wife Susanna, who was a Davis (Wythe County Will Book 9, pp . 80,81; Wythe county Order Book 1815-1820, p. 41; Order Book 1812-1815 , p. 99) .

From the settlement of the estate of John Davis, Jr. or II, in Deed Book 6, page 426, it appears that his heirs in May 1816 were three sons, William[Executor of the estate], George who was living elsewhere, and Abraham Davis, and the following men who were probably sons-in-law: Charles Woodson , Spencer Lahue, Larkin Johnston, Jacob Harrell, and Henry Hufford. Marriage records could be checked for names of husbands and marriage dates for John Davis's daughters. However early marriage records were left scattered in the courthouse basement for years, and for this reason, no record has been found of the marriage of Mary or Polly Davis and Larkin Johnston.
