"John Bailey was drafted in Albemarle County in 1777 under Capt. Landon Jones and Lt. James Wood and was attached to the First VA Regt. under Colonel Nelson, later drafted under Capt. John Harris and Lt. Ralph Thomas. Third draft was under Capt. Mark Leake and Lt. John Warton. He resided in Kanawha County in 1833."

Albemarle Declaration 21 Apr. 1779 "We whose name are hereunto subscribed do swear that we renounced and refuse all allegiance to George the King of Great Britain and that we will be faithful and bear true allegiance to the Commonwealth of Virginia as a free and independent state.We swear to oppose and, if discovered, make known to the authorities all treasons or traitorous conspiracies.. against this or any of the United States of America So help us God."

This Indenture made the twenty second day of February, 1812, between John Bailey and Frances his wife and several (unreadable) of the one
part and Samuel S. Perkins & Fanny his wife of the other part, witnesseth that the said John Bailey and wife and Samuel Anderson for an in
consideration of the sum of 40 dollars paid to them in hand have granted, bargained and sold and by these presents do grant, bargain and sell unto the said Samuel Perkins and Fanny his wife and to their heirs or assigners forever one certain tract or parcel of land lying and being on the waters of Hickory Creek in Nelson Co. and containing by a late survey forty acres more or less and bounded as follows (various surveying measurements listed).

To have to to hold the aforesaid tract or parcel of land to the said Samuel Perkins and Fanny his wife and their heirs forever and the said
John Bailey and Frances his wife & Samuel Anderson for themselves and their heirs doth conversant with the said Samuel Perkins and Frances

Will of John Bailey dated March 21, 1821 proved Oct. 27, 1923--Nelson County, VA

In the name of God Amen, I John Bailey, of Nelson Co., VA and State of Virginia being of sound mind and memory and calling to mind the uncertainty of life doth hereby make my last will and testament hereby revoking all other wills by me hereto made.

Item: My will and desire is that all my just debts be paid and satisfied by my executors hereinafter named, as early after my decease as convenient.

Item: My will and desire is that all my slaves and my five(5) lands be divided into five equal lots, and that my sons John Bailey Jr., Samuel Bailey, Tershia Bailey, James Bailey, and my daughter Jane Smith be entitled each to one fifth part of the whole, or one lot so laid off and divided. It is understood that my beloved wife Francis Bailey have titled to and enjoy the whole during her natural life, and it is further my will that my negro woman Fanny, shall have liberty of choosing her master or mistress at valuation and to be accounted for in the allotment aforesaid.

Item: It is further my will and desire that my beloved wife Francis Bailey hold and enjoy all balance and residue of my Estate, both real and personal (After payment of my just debts and funeral expenses) for and during her natural life, and that so soon after her death, in case she shall be the longest liver, that the whole thereof be sold upon such terms as my executors who shall be then living think most beneficial,and thereof divided into five equal parts and that my aforesaid 5 children to-wit, John Bailey Jr., Samuel Bailey, Tershia Bailey, James Bailey, and Jane Smith, or their legal representatives in case of death of them have title thereto, and receive and enjoy the same to their use and behoof forever.

Item: It is my will and desire that my son Elisha Bailey and my daughter Betsey Turner to receive no part of my Estate what ever, as I have heretofore given them as much as I think my other children will receive, all which I have heretofore given them I do hereby ratify and confirm.

Item: I do hereby give and convey unto my 5 said children to-wit John Bailey Jr., Samuel Bailey, Tershia Bailey, James Bailey, and Jane Smith the property herein conveyed to them to take effect after the death of my beloved wife Francis Bailey a full and complete title to them and their heirs forever.

Item: I do hereby consitute and appoint my son Terisha Bailey and my son-in-law Charles Smith my executors, My beloved wife Francis executrix of this my last will and testament with request that they carry the same into execution. Given from under my and hand and seal at my own house in Nelson Co. VA this 2nd day of March in the year of our Lord one thousand and eight hundred and twenty.

Frances Montgomery was born in St. Anne's Parish, VA. He bought and moved to what is now near Batesville, VA, on Meacham's River.
He moved with 72 family, friends and slaves to the Ozark area of Adair Co., KY, purchasing 1000 acres set aside for VA militia who had fought the British.
He served as an Ensign in the Albemarle Co., VA Militia during the American Revolution.

Cemetery notes and/or description:
This cemetery is the original burial ground for the Francis Montgomery, Sr. family in Adair County. It was originally enclosed by a split rail fence that has long since deteriorated. Many slaves were said to have been buried immediately outside of the cemetery. All of the stones are rough fieldstones or slate, most of which have no markings left. Many have sank into the ground or been broken by cattle and timber. There are about eight rows of graves.

To reach the cemetery from Columbia, follow Hwy 80 east towards Russell Springs for about 5 miles and turn right on Reeves Road. About three quarters of the way down Reeves Road, directly across from Ozark Trail which is on the left, there is an unmarked path that goes out into a field on the right. About a hundred yards down the unmarked path, there is a large tree on the left and a small fenced cemetery on the right. Go left (southwest) through the field towards the large tree and past it, and cross the fence behind it. After crossing the fence, walk approximately 25 yards southwest into the trees to reach the cemetery. It is on the property of Bruce Wilson. The exact location is marked on the map below. 1850 Census, William W. Eddings was enumerated in Greene County , Alabama with his wife Marina, sons Jesse and Edelbert, daughters Mary, Elizabeth, Virginia, and Julia. He was 46 years old, born in South Carolina and a farmer with real estate valued at $2,600.00.

In 1856 William W. Eddins moved to Washington County, Texas. The soil was fertile and this was the location of Baylor University (Independence, Texas), already reputed to be a quality Baptist school.

From 1856 through 1864, WW owned 527 acres on Kuykendall Creek , 38-40 slaves 10-15 horses and 16-80 head of cattle.

In 1860 Census William Eddins was enumerated in Independence, Washington, Texas with his wife Marina, daughters Lizzie, Virginia , Julia, Emma, Ida, sons William, John, Offa. He was 55 years old and born in South Carolina. He was a farmer with real estate valued at $6,000 and personal property worth $31,930.

From 1865 through 1867, year of his death, he no longer had slaves. In 1870 his estate lists only 103 acres but there are 3 town lots in Brenham. The estate seems to be in the hands of Charles R. Breedlove, his oldest daughter's husband.

Departed this life, on Wednesday, the 17th of February, after a protracted illness, Mr. Joel Smith, son of Mr. Charles Smith, of Albemarle county, aged twenty-four years and three months. Perhaps no youth contained a better moral characted, than did the subject of this obituary. He had for several years manifested much concern for the salvation of his soul. Not willing to be satisfied with any thing short of being built on the sure foundation,--Jesus Christ, he investigated closely and thoroughly, the subect of religion, and the depravity of his own heart. Sometime before his death, he was enabled to make a full surrender of his heart and soul to his Redeemer--after which he manifested an entire resignation to the will of God. Often did he express a wish to praise God more than his debilitated state would permit. Calm, collected, and composed, he fell asleep in Jesus. Parents and friends may dry up their tears of sorrow, and join together in praising God for his goodness.

Mrs. Virginia Coffey, a Fine Christian Character, a Loveable Woman, Gone to Her Reward.
The land marks of Columbia are fast passing to a better world. On Thursday forenoon [January 11] Mrs. Virginia Coffey, who was the widow of the late Jo Coffey, succumbed with diseases incident to old age, at her apartment on Burkesville Street. The hour of her passing was eleven o'clock, and the ending was peaceful.
The deceased was a daughter of W.W. and Sophia Page and her entire life was spent in Columbia and upon her father's farm, a few miles out the Jamestown road. When quite a young woman she married Mr. Jo Coffey, a prominent business man of this town. To this union seven children were born, six sons and one daughter. The names of those living are W.A., John B. and Geo. R. Coffey. One brother is yet living, Dr. J.N. Page, whose home is in Louisville, and one sister, Mrs. Ellen Wheat, who lived in the home with her.
Mrs. Coffey was reared in the Presbyterian faith and early in life she became a member of that congregation in Columbia, and no more consecrated child of God is identified with that body of religious people. She was at all times in her pew, and when upon the streets she never failed to ask her younger friends to attend Church, and to walk in the fear and admonition of the Lord. Her long life, lacking until next June of being eighty years old, was beautifully spent, and no fears of death came her way. Socially, she was loved by the old and the young, and many hearts ached when the intelligence spread over this community that God had called her to a better world. She will be missed not only by those who were near and dear to her, but by every one who had the good fortune to know her. There was no selfishness in her make up, and when religious services were not held in the church she was identified with, she attended one of the other congregations in the community, and never failed to say a good word for the minister who expounded the Gospel of the lowly Nazarene.
The funeral services were held Friday afternoon at 2 o'clock, in the Presbyterian church, conducted by Rev. R.V. Bennett, assisted by Rev. Jessie L. Murrell, and Rev. Carson Taylor. It was a beautiful and touching service, a more consoling discourse than the one delivered by Rev. Bennett is not often heard. He did not overdraw all expression in speaking of the Christian character of the deceased, and it was certainly consoling to the loved ones of the departed mother.
After the conclusion of the services at the church, the remains were conveyed to the city cemetery and deposited by the grave of her husband, her mount literally covered with fragrant and beautiful flowers.
There were a number of out of town relatives and friends from different places. We noticed Mr. and Mrs. W.R. Lyon, Mr. and Mrs. W.H. Wilson, Campbellsville, Mr. Philson Smith and Mr. Will Lewis, of Greensburg.

In the name of God, Amen: I Mary E. Smith of the County of Albemarle and the state of Virginia, being far advanced in years, but of sound and disposing mind, memory and understanding remembering the certainty of death, & the uncertainty of time thereof & being desirous to fix my worldly affairs before it shall please God to call me home, do make and ordain this my last Will and Testament, in manner & form following. First & principally I commit my Soul to God (who gave it) and my body to the earth to be buried in a Christian like manner, and as to such worldly effects or property as I own or possess do dispose of the same in manner & form following as herein stated.
Item the first - I give and devise without restriction unto Sarah E. Smith and her children forever a Bond of twelve thousand dollars executed by Robert P. Smith to me on settlement made on the first day of January 1866, and which bond bears date on that day, which said bond and the money owing thereof I give and devise to the said Sarah E. Smith & her children & their heirs for ever.
Item the second - All other property of any description which I own or have claim to, or may hereafter procure or own or claim at the time of my death, I give & devise unto the said Sarah E. Smith & her children & their heirs forever.
Item the third - I devise and direct that all my just debts if any at my death, be first paid out of my estate.
Item the fourth - The devise contained in the first Item of this will is subject to the provisions contained in this item to wit: I hereby constitute and appoint Doctor A. Montieso of Albemarle County, trustee for the said Sarah E. Smith and her children, and as such to have the contract and management of the said Bond of twelve thousand dollars and he is hereby empowered to collect the same or such part thereof remaining unpaid at my death and also any other property or debts due me, or held by me and with the proceeds of said Bond debts and other property to purchase such land or other proberty for said Sarah E. Smith and her children as he may seem most condusive to their interest, to be equally possessed and enjoyed by each of them, which duties & devises however. The said trustee is not to perform until the youngest of said children shall have attained the age of twenty one years.
